The following represents the first four
parts of the Provisional Constitution, being the Preamble,
Statement of Rights, Proscriptions and
Responsibilities, The Renunciuation of War and The Office of
Emperor.
The Constitution of the Empire of
Atlantium
Preamble
Be it known that we, the Atlantian
people, accepting allegiance to no higher authority
and united by common purpose hereby freely constitute
ourselves as a secular Imperial commonwealth of
Sovereign Citizens, to be hereafter known as the
Empire of Atlantium.
We hold as truth the essential genetic
equality of all peoples, whose political unity we
advocate, and we strive to equitably afford each
Citizen of our Imperium the means and the opportunity
to fully realise their potential.
We formalise hereunder the precepts by
which we conjointly agree to define our governance,
and pledge ourselves and our successors to this
Constitution.
Chapter I
Statement
of Rights, Proscriptions and Responsibilities
Rights
Article I
All Citizens have the right to
life, liberty and personal security.
Article II
All Citizens have the right to
equality in law, irrespective of age, race, sex,
sexuality or disability.
Article III
All Citizens have the right to
freedom of belief and of expression.
Article IV
All Citizens have the right to
freedom of peaceful assembly and association.
Article V
All Citizens have the right to
freedom of movement and residence.
Article VI
All Citizens have the right to
personal property.
Article VII
All Citizens have the right of
equal access to public services.
Article VIII
All Citizens have the right to
nominate for public office.
Article IX
All Citizens have the right to
a fair and public hearing by an independent and
impartial tribunal, in the determination of their
rights and obligations and of any criminal charge
brought against them.
Article X
All Citizens have the right to
freedom of choice in all respects that pertain to
their physical person, including the right to
pregnancy termination and the right to assisted
suicide.
Proscriptions
Article XI
No Citizen may be executed by
the State or its instrumentalities.
Article XII
No Citizen may be held in a
state of slavery or enforced servitude.
Article XIII
No Citizen may be subjected to
torture or to physical violence.
Article XIV
No Citizen may be subjected to
arbitrary arrest, detention or exile.
Article XV
No Citizen may be arbitrarily
deprived of their property.
Responsibilities
Article XVI
All Citizens have the
responsibility to pay taxation in support of the
State and its instrumentalities.
Article XVII
All Citizens have the
responsibility to vote in elections for the
Legislative Branch of Government.
Article XVIII
All Citizens
have the responsibility not to impinge upon the
rights of fellow Citizens, in the free exercise of
their rights.
Chapter II
Renunciation
of War
Article XIX
Aspiring to an international peace based
on justice, order, mutual respect and positive
engagement, the Empire of Atlantium renounces its
Sovereign Right to the use of all forms of external
aggression, threat or force, including the
maintenance of permanent State military institutions.
Chapter III
The
Office of Emperor
Article XX
The Sovereign Head of State of
the Empire of Atlantium is the Emperor, who is the
First Among Equals.
Article XXI
The Emperor is the
personification of the State and of the unity of the
people, deriving his or her Office and Executive,
Legislative, and Judicial Authority from the Citizens
of the Empire in whom resides Sovereignty.
Article XXII
The Emperor reigns, but rules
only indirectly as a permanent, moderative member of
the Executive Government.
Imperial Succession
Article XXIII
The Emperor is
elected to Office, reigning for life, or until
voluntary abdication or removal due to legally and
medically certified permanent incapacitation.
Article XXIV
The Emperor may be removed
from Office only by means of a seventy five or
greater percentage vote of a special joint sitting of
the Imperial Senate, convened within five days of the
receipt by the First Consul of formal legal and
medical certification of the Emperor's permanent
incapacitation.
Article XXV
Within ten days of the
abdication, legally and medically certified permanent
incapacitation or death of a reigning Emperor, the
members of the Imperial Nobility, convening as the
Imperial Electoral Convocation will nominate, by
means of one or more secret ballots, a successor from
amongst their number.
Article XXVI
Subsequent to nomination by the Imperial
Electoral Convocation, the Emperor-elect must have his or her
position ratified by not less than 75% of the membership of the
Imperial Senate sitting in joint session, within two days of being
so nominated. In the event that Senatorial ratification fails the
process of nomination and ratification will be continued as detailed
within this Constitution until such time as a candidate acceptable
to both the Imperial Electoral Convocation and the Imperial Senate
is confirmed as Emperor.
Appointments
Article XXVII
The Emperor
appoints the First Consul and the Ministers of State
as designated by the Concilium.
Article XXVIII
The Emperor
directly appoints two thirds of the membership of the
Senatus.
Article XXIX
The Emperor
directly appoints the First Senator.
Article XXX
The Emperor appoints the
Magister Aequitas as designated by the Concilium.
Article XXXI
The Emperor directly appoints
eminent Citizens to membership of the Imperial
Nobility.
Article XXXII
The Emperor
directly, or as designated by the Executive
Government, awards Imperial Honours.
Functions
Article XXXIII
The Emperor
performs the following acts in matters of State on
behalf of the Citizens of the Empire:

Exercise of the Moderative Power of
Veto, as provided for by law.
B
Promulgation of Amendments to the
Constitution, laws, Executive Government Edicts and
treaties.
C
Convocation and dissolution of the
Imperial Senate.
D
Proclamation of general elections for
members of the Concilium.
E
Attestation of the appointment and
dismissal of Ministers of State and other officials
as provided for by law, and of full authorities and
credentials of diplomatic representatives and
Ministers of State.
F
Attestation of general and special
amnesty, commutation of punishment, reprieve, and
restoration of rights.
G
Attestation of instruments of
ratification and other diplomatic documents as
provided for by law.
H
Receiving external diplomatic and
governmental representatives.
I
Performance of ceremonial functions,
including the conduct of Noble investitures and the
award of Imperial Honours.
Rule of Law for the Emperor
Article XXXIV
The Emperor
may perform only such acts in matters of State as are
provided for in this Constitution.
Article XXXV
The Emperor
may delegate at his or her discretion, the
performance of his or her functions in matters of
State as may be provided by law.
